Entitlements from a Motor Vehicle Accident

In New South Wales, compensation following a motor vehicle accident is governed by the Motor Accident Injuries Act 2017 (NSW). The entitlements available depend on the circumstances of the accident, including the degree of fault and the nature and severity of the injuries.

Most people injured in a motor vehicle accident can access statutory benefits regardless of who was at fault, which may include payments for medical treatment, care and income support. The duration of these benefits depends on whether the injuries are classified as threshold injuries and whether the injured person was mostly at fault for the accident.

When another driver is at fault and the injuries are more serious, additional compensation through a common law damages claim may also be available. Damages claims of this type are particularly valuable in most cases, providing a single damages payout that reflects the assessment of damages for pain and suffering over a lifetime and all past and future economic loss. 

In some cases, home modifications or accommodation and lifelong travel expenses can be included in the damages settlement sum. These cases necessarily require proof that the injuries are non-threshold injuries, which generally involve injuries that include orthopaedic or fracture injuries, psychological injury or injuries that are not purely ‘soft tissue’.

A motor accident is an incident involving the use or operation of a motor vehicle that results in injury or death to another person. This occurs while a vehicle is being driven, during a collision with another vehicle, or when the driving of a vehicle creates a dangerous situation that leads to injury.

Motor accident claims commonly arise from car crashes, motorcycle accidents, pedestrian incidents or other road collisions. In these situations, people can seek advice from motor vehicle accident lawyers to understand whether they can pursue a compensation claim.

All motor vehicles that are driven on public roads in NSW are required to hold a compulsory third-party insurance policy as a condition of the vehicle’s registration. The policy is uncapped, and compensation is dependent upon the entitlements set out in the legislation.

If the accident occurred on a public road, the State Insurance Regulatory Authority (SIRA) will appoint an insurer to administer and pay for the claim.

You need to send a Personal Injury Claim Form to the insurance company within three months of the date of the motor vehicle accident. However, the insurer will not make weekly payments until the claim form is served unless it is sent to the insurer within 28 days of the accident.

The scheme can apply to drivers and passengers involved in a car accident, as well as pedestrians, motorcycle riders, cyclists and people injured while travelling in buses, taxis or other motor vehicles used for public transport.
