A motor accident is an incident or accident involving the use or operation of a motor vehicle that causes death or injury to a person during driving of the vehicle or a collision or a dangerous situation caused by the driving of a vehicle.

All motor vehicles that are driven on public roads in NSW are required to hold a compulsory third party insurance policy as a condition of the vehicle’s registration.

If the accident occurred on a public road, SIRA (State Insurance Regulatory Authority) will appoint an insurer to administer and pay for the claim.

You need to send a Personal Injury Claim Form to the insurance company within three months of the date of the motor vehicle accident.

However, the insurer will not make weekly payments of compensation until the claim form is served unless it is sent to the insurer within 28 days of the accident.

For many compensation claims, we offer a no-win, no-fee agreement.  That means you only pay legal fees if you receive compensation from the insurer.

In motor vehicle accident claims, you will not receive a bill from us if you receive less than $75,000.00.   If the claim is worth more than that, the insurer will pay approximately two-thirds of your legal costs and you will be required to pay the balance from the settlement or verdict when recovered.
